These Terms of Use ("Terms") govern your access to and use of the websites operated by Applied Behavior Consultants, Inc. ("ABC," "we," "us," or "our"), including www.abcreal.com and app.abcreal.com (together, the "Sites"). By accessing or using the Sites, you agree to be bound by these Terms. If you do not agree, please do not use the Sites.

No Medical or Professional Advice

The Sites provide general information about ABC and applied behavior analysis (ABA) services, including educational materials such as information about The R.E.A.L. Model™. This information is provided for general purposes only and is not medical, behavioral, psychological, or other professional advice. Using the Sites does not create a provider–patient or therapeutic relationship between you and ABC. Always seek the advice of a qualified professional with any questions about a medical or behavioral health condition, and never disregard professional advice because of something you read on the Sites.

Not for Emergencies

The Sites are not intended for medical or behavioral emergencies. If you or your child is experiencing an emergency, call 911 or go to the nearest emergency room. If you or someone you know is experiencing a mental health crisis, you can also call or text 988, the Suicide and Crisis Lifeline.

Privacy and Health Information

Your use of the Sites is also governed by our Privacy Policy and, where applicable, our Notice of Privacy Practices. Please do not submit protected health information (PHI) or other sensitive personal information through general website forms or email, which are not secure methods of communication. For matters involving your child's care, please use the communication channels we provide for that purpose.

Intellectual Property

The Sites and their content — including text, graphics, logos, images, the "Applied Behavior Consultants, Inc.®" name, and "The R.E.A.L. Model™" — are owned by or licensed to ABC and are protected by copyright, trademark, and other laws. We grant you a limited, personal, non-commercial license to view and use the Sites for their intended purpose. You may not copy, reproduce, distribute, modify, republish, or create derivative works from any content on the Sites without our prior written permission.

Purchases and Payments

The Sites may allow you to purchase products and services — such as publications, training programs and continuing education (CEU) offerings, and telehealth consultation time — and to make insurance co-payments or private-pay payments. By making a purchase or payment, you agree to provide accurate and complete information and authorize the applicable charge.

Payments are processed by third-party payment providers (such as PayPal). Your use of those services is subject to their own terms and privacy policies. ABC does not receive or store your full payment card information through the Sites.

Continuing education and training purchases may be subject to additional terms presented at the time of purchase, including completion, attendance, and certificate requirements.

Telehealth Consultations

Purchasing a consultation through the Sites reserves consultation time; it does not by itself establish an ongoing care or treatment relationship. Clinical services, when provided, are governed by separate intake, consent, and service agreements.

Acceptable Use

When using the Sites, you agree not to:

  • use the Sites for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorized access to any portion of the Sites, accounts, or systems;
  • interfere with or disrupt the Sites or their security;
  • upload or transmit any virus, malware, or other harmful code; or
  • use the Sites to harass, abuse, or harm another person.

User Submissions

If you submit information through the Sites — for example, a contact or grievance form — you are responsible for the accuracy of what you provide and confirm that you have the right to share it. As noted above, please do not include PHI or other sensitive information in unsecured submissions.

Third-Party Links and Services

The Sites may contain links to third-party websites and services that we do not control, such as our employee portal, employee benefit portal, payment providers, social media pages, and informational resources. We provide these links for convenience only and are not responsible for the content, products, or practices of third-party sites. Your use of any third-party site is at your own risk and subject to that site's terms.

Disclaimers

The Sites and their content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Sites will be uninterrupted, timely, error-free, or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, ABC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, or goodwill, arising out of or relating to your use of the Sites.

Indemnification

You agree to indemnify and hold harmless ABC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Sites or your violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Sites will be brought in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of those courts.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the effective date above. Your continued use of the Sites after changes take effect means you accept the revised Terms.

Termination

We may suspend or terminate access to the Sites at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to ABC, other users, or third parties.
